1. Agreement to Terms

These General Terms and Conditions ("Terms") govern your access to and use of The Adventure Collective Network websites and platform ("Platform"), operated by AdvGuides, LLC, a North Carolina registered corporation, doing business as The Adventure Collective ("Company," "we," "our," or "us"). By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access or use our Platform.

2. Description of Service

The Adventure Collective operates as a tour reseller and affiliate marketplace platform that connects adventure seekers with independent tour operators, guides, and outfitters. We provide:

• Discovery and booking tools for adventure activities worldwide
• Aggregated content from third-party booking platforms (FareHarbor, Viator)
• Reviews and ratings from TripAdvisor, Google, and direct user feedback
• Information about destinations, activities, gear, and adventure guides
• Marketing and promotional services for adventure operators

IMPORTANT: We act as an intermediary marketplace, affiliate platform, and information publisher. We do not directly operate adventure tours or activities. All tours and activities are provided by independent third-party operators. We earn revenue through affiliate commissions and referral fees when bookings are made through our platform.

3. User Accounts

3.1 Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or other reasons at our sole discretion. You may also close your account at any time by contacting us.

4. Bookings and Reservations

4.1 Booking Process

When you make a booking through our Platform, you enter into a direct contract with the adventure operator or tour provider. We facilitate the booking but are not a party to the contract between you and the operator.

4.2 Pricing and Payment

Prices displayed on our Platform are provided by tour operators and third-party booking partners. Prices may change without notice. You agree to pay all charges at the prices in effect when you make your booking, including any applicable taxes and fees.

Payment is processed through secure third-party payment processors. We do not store your complete credit card information.

4.3 Cancellations and Refunds

Cancellation and refund policies are set by individual tour operators and vary by activity. These policies will be clearly displayed before you complete your booking. Refund requests must be directed to the tour operator or processed according to the operator's stated policy.

AdvGuides is not responsible for issuing refunds but may assist with customer support inquiries.

4.4 Changes and Cancellations by Operators

Tour operators reserve the right to cancel or modify activities due to weather, safety concerns, insufficient participants, or other reasons. In such cases, operators will typically offer rebooking options or refunds according to their policies.

5. Assumption of Risk and Liability

5.1 Inherent Risks of Adventure Activities

IMPORTANT: Adventure activities listed on our Platform involve inherent risks, including but not limited to physical injury, illness, or death. These activities may take place in remote locations with limited medical facilities. By booking an adventure activity, you acknowledge and accept these risks.

5.2 Health and Fitness Requirements

You are responsible for ensuring you meet the health, fitness, and skill requirements for any activity you book. You must disclose all relevant medical conditions, medications, and physical limitations to the tour operator. Failure to disclose such information may result in denied participation without refund.

5.3 Limitation of Liability

IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVGUIDES SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, DAMAGE, OR EXPENSES ARISING FROM OR RELATED TO YOUR PARTICIPATION IN ADVENTURE ACTIVITIES BOOKED THROUGH OUR PLATFORM. This includes but is not limited to:

• Personal injury, illness, or death
• Loss or damage to personal property
• Cancellations or changes by tour operators
• Weather-related disruptions
• Acts of nature, accidents, or unforeseen events
• Conduct or negligence of tour operators, guides, or other participants
• Inaccurate, outdated, or incomplete information on our Platform
• Technical errors, website outages, or booking system failures

Affiliate Bookings: When you book through affiliate links to third-party platforms (such as FareHarbor or Viator), you enter into a direct contract with those platforms and the tour operators. AdvGuides receives only affiliate commission and does not receive any direct payment from you. In such cases, AdvGuides has no liability for the booking, the activity, refunds, or any other aspect of your transaction. All claims must be directed to the booking platform or tour operator.

Monetary Damages: In no event shall AdvGuides' total liability to you for all damages exceed the lesser of (a) the actual fees you paid directly to AdvGuides (if any), or (b) $100 USD. For affiliate bookings where no fees are paid to AdvGuides, our liability is expressly excluded.

5.4 Third-Party Operators

Tour operators and guides listed on our Platform are independent businesses. We do not employ, control, or supervise these operators. We do not guarantee the quality, safety, or legality of their services. Any disputes or claims arising from your participation in activities must be directed to the tour operator.

5.5 Insurance

We strongly recommend that you obtain comprehensive travel and adventure activity insurance, including coverage for medical expenses, evacuation, trip cancellation, and personal liability. Some tour operators may require proof of insurance.

6. User Conduct and Prohibited Activities

You agree not to:

• Violate any laws, regulations, or third-party rights
• Post false, misleading, or fraudulent information
• Impersonate any person or entity
• Harass, abuse, or harm other users or operators
• Upload viruses, malware, or other malicious code
• Scrape, harvest, or collect data from the Platform without permission
• Interfere with the proper functioning of the Platform
• Use the Platform for unauthorized commercial purposes
• Post inappropriate content, including offensive, discriminatory, or explicit material
• Circumvent any security features or access restrictions

7. Reviews and User-Generated Content

7.1 Posting Reviews

You may post reviews and ratings based on your experiences. Reviews must be honest, accurate, and based on your personal experience. You may not post fake reviews or reviews on behalf of others.

7.2 Content License

By posting content (reviews, photos, comments) on our Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting our Platform.

7.3 Content Moderation

We reserve the right to remove any content that violates these Terms, is offensive, or is otherwise inappropriate, at our sole discretion. We do not pre-screen all user content but may monitor and review content.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, images, software, and compilations, is the property of AdvGuides or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from our content without express written permission. Limited use for personal, non-commercial purposes is permitted.

9. Third-Party Content and Links

Our Platform integrates content from third-party sources, including FareHarbor, Viator, TripAdvisor, and Google Reviews. We display this content under appropriate licenses and partnerships but do not control or guarantee its accuracy or availability.

Links to third-party websites are provided for your convenience. We do not endorse or assume responsibility for the content, privacy policies, or practices of third-party sites.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• Information on the Platform is accurate, complete, or current
• Defects will be corrected
• The Platform is free of viruses or other harmful components

11. Indemnification

You agree to indemnify, defend, and hold harmless AdvGuides, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your participation in adventure activities booked through the Platform

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

12.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be settled by binding arbitration in Asheville, North Carolina, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

12.3 Exceptions to Arbitration

Either party may seek injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorized use of the Platform.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and AdvGuides regarding your use of the Platform.
